Code of Conduct

1. Please be Respectful
Be respectful to other members–both inside the server and outside of the Bloom Community server (DMs, social media, etc.). Be respectful in your conduct (no harassment, bullying, harmful language, or aggressive behavior) and be respectful of the privacy of others. Unkind actions will not be tolerated. Do not screenshot and share messages outside of the server unless you are reporting harmful behavior.

2. No Spamming Channels
Do not send a lot of small messages right after each other aka spamming. This includes random out of context text or images, links or emojis. No roleplaying, excessive spam-singing, or unnecessary use of @ tags to people. Keep your discussions relevant and ensure that others can benefit from them.
3. No pornographic/adult/or other NSFW content
Please keep this a positive, safe, and encouraging environment for everyone! Sexually explicit, violent, illegal, or other not safe for work (NSFW) content will not be tolerated. This includes profile pictures and names. Profanity and other explicit content will be removed and may result in your removal.
4. No profanity or inappropriate language
The use of profanity is not appropriate. Derogatory language towards any member is not allowed. This includes profile pictures and names.
5. No Self Promotion or Advertising
If you did something cool, share it in the discussions channel, but don't use it for excessive self-promotion. We do not tolerate any kind of advertisements, whether it be for other communities or streams. You can post your content in the media channel if it is relevant and provides actual value (Video/Art)
6. No Server Raiding
We don’t allow members to raid other servers without asking for permissions. You must ask any moderator, else the way, and you will get a ban for a lifetime.
7. No Threats
Threats to other users of DDoS, death, DoX, abuse, and other malicious threats are absolutely prohibited and disallowed.
8. Keep Your Personal Information Safe
This is a safe space BUT avoid oversharing. Never share things like your full name and address. Do not post things online that you would not want anyone else to see.
9. Follow the Official Discord Guidelines.
Apart from the rules of the Bloom Community server, you must also follow the official Discord guidelines to use this app: https://discordapp.com/guidelines
10. Report All Questionable Activity
While moderators are actively searching for inappropriate content/behavior, please help us keep our community safe by reporting any questionable activity/content to the moderators. If you see something, say something!
11. Respect the Mods and Rules.
The moderators will mute/kick/ban per their discretion. All moderator decisions and bans are final. Please respect their decisions!
All Bloom Community channels will have pinned messages explaining what they are there for and how everything works. If you don't understand something, feel free to ask!
Your presence in the Bloom Community server implies accepting these rules, including all further changes. These changes might be made at any time without notice; it is your responsibility to check for them. Bloom or its affiliates are not responsible for anything that happens on the Bloom Community server.
A NOTE TO PARENTS/GUARDIANS: While Bloom is committed to actively scrutinizing and moderating the Bloom Community, we also rely on parent/guardian cooperation to ensure the safety of all members. Please discuss online behavior and safety with your teen and determine appropriate boundaries and guidelines that work for your family. Bloom: Empowering the Military Teen (“Bloom” or “we”) utilizes the communication platform Discord to host the Bloom Community server (the “Bloom Community”). The Bloom Community is run by and moderated by military teen volunteer moderators (“moderators”) supervised and supported by National Military Family Association (“NMFA”), a nonprofit organization. This Terms of Use Agreement (“Terms of Use”) details the legally binding terms that you agree to follow by registering and utilizing the Bloom Community as a “member” (meaning that you have created a Discord account, have registered for the Bloom Community, and are an approved member of the Bloom Community). By accessing and using the Bloom Community, you and your parents/guardians (if you are under the age of 18) agree that you have read and agree to these Terms of Use and that your access, use, and participation in the Bloom Community is subject to these Terms of Use and the Code of Conduct.

You also understand while Discord operates the software itself and provides the tools for Bloom to create, customize, and moderate the Bloom Community, as well as for individual users to create, customize and interact with their own personalized accounts, Discord is not affiliated with Bloom, NMFA, or the Bloom Community in any way. To join the Bloom community you must create a Discord account and you must abide by all terms and rules set by Discord, and should read Discord’s Terms as well before registering for a Discord account. Bloom is considered the owner of the Bloom Community and possesses moderation, screening, and customization capabilities.

1. Membership
Membership in the Bloom Community is exclusively reserved for military affiliated teenagers no younger than 13 years of age and no older than 20 years of age. Prospective members will be asked to verify their military affiliation by answering questions on the registration form. By registering for the Bloom Community, you represent and warrant that you meet the eligibility requirements at the time of registration.
If you are suspected of falsifying eligibility information, your access to the Bloom Community may be revoked at any time without prior notice. If you turn 21 at any point during your membership, you may be removed from the Bloom Community.
You are free to stop using the Bloom Community at any time and for any reason.
2. Personal Information
The following information may be collected by Bloom during registration:

This information, and any other information required for registration, will be used to verify Bloom Community eligibility, contact members to grant access to the Bloom Community, and determine when users are no longer eligible to be members in the Bloom Community. This information will not be shared outside of Bloom or the Bloom Community moderators.
3. Use of Content
Members assume responsibility for all content that they post and must understand that anything they post on the Bloom Community is online and viewable by all members and moderators. Content created within the Bloom Community will be used solely for use by Bloom and personal consumption of the members. Members agree not to use the Bloom Community or content posted on the Bloom Community for commercial purposes or illegal purposes. Bloom may, in its sole discretion, keep record of members’ content posting as necessary to ensure the safety, security, and well-being of other members.
4. Content Management
Bloom Community moderators reserve the right to reject or remove any content posted to the Bloom Community for any or no reason at their discretion and are not required to provide notice, warning, or reasoning to users.
Members are solely responsible for any content that they post within the Bloom Community. Bloom assumes no responsibility for content posted by individual users. While moderators are committed to keeping the Bloom Community clean and safe for its members, Bloom and the moderators shall not be held liable for content posted by members or if inappropriate or offensive content is not removed immediately.
Members are also expected to be responsible components of the Bloom Community. If you see something, say something – please report any inappropriate behavior or content to a moderator.
5. Prohibited Content/Activity
The following content is prohibited on the Bloom Community:
a. Content that is offensive and promotes hatred, bigotry, racism, or violence toward any individual or group
b. Content that is sexually explicit or exploitative
c. Content that contains obscene or profane language
d. Content that attempts to gather personal information from anyone under 18
e. Content that promotes political causes or endorses a particular candidate or party
f. Content that constitutes propaganda
g. Content that contains graphic or excessive depictions of violence
h. Content that promotes criminal or otherwise illegal activity
i. Content that violates the privacy of any individual or organization
j. Content that violates the intellectual property rights of anyone else
Bloom reserves the right to remove any user from the Bloom Community if, in the sole discretion of any of the moderators, any of the above content is shared.

All members must also agree to abide by the Code of Conduct, which outlines more specific guidelines for content, as well as any applicable Discord code of conduct.

6. Disputes Between Users
Members are solely responsible for their interactions with other members of the Bloom Community. Moderators reserve the right but hold no obligation to intervene in the event of a dispute, argument, or conflict between members. Moderators may use their personal discretion to remove members from the Bloom Community in their sole discretion without advance notice or explanation of reasoning.
Additionally, Bloom and Bloom Community moderators bear no responsibility for or obligation to address disputes and interactions between members of the Bloom Community that take place outside of the Bloom Community, such as in Discord private messages, other servers, on social media, or other platforms. However, members concerned about the harmful activity of another member outside of the Bloom Community should contact moderators with their concerns. Moderators reserve the right to use their discretion to remove members who are causing harm to other members, even if this harm occurs outside of the Bloom Community.
7. Liability Disclaimer
All members utilize and participate in the Bloom Community at their own discretion and risk.
IN JURISDICTIONS WHERE EXCLUSIONS OR LIMITATIONS OF LIABILITY ARE ALLOWED, NEITHER BLOOM, NMFA, THEIR AFFILIATES, NOR THEIR MODERATORS, VOLUNTEERS, EMPLOYEES, OR AGENTS INVOLVED IN MANAGING, PRODUCING, OR DELIVERING THE BLOOM COMMUNITY WILL BE LIABLE, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOST REVENUES, LOST SAVINGS, LOST BUSINESS OPPORTUNITY, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OF USE OR FROM THE USE OF OR INABILITY TO USE THE BLOOM COMMUNITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT BLOOM, NMFA, OR THEIR MODERATORS, VOLUNTEERS, EMPLOYEES OR AGENTS HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY PROVIDED IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

BESIDES THE TYPES OF LIABILITY BLOOM CANNOT LIMIT BY LAW (AS DESCRIBED IN THIS SECTION), BLOOM LIMITS OUR LIABILITY TO YOU TO $100 U.S. DOLLARS.
BLOOM IS NOT LIABLE FOR THE CONDUCT OR CONTENT, WHETHER ONLINE OR OFFLINE, OF ANY MEMBER OF THE BLOOM COMMUNITY.
THE EXCLUSIONS AND LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE
BARGAIN BETWEEN BLOOM AND YOU.
8. Bloom Community is Offered “As Is”
WE WORK HARD TO OFFER A GREAT EXPERIENCE, BUT THERE ARE CERTAIN ASPECTS THAT BLOOM CANNOT GUARANTEE. TO THE FULLEST EXTENT PERMITTED BY LAW, BLOOM, NMFA, ITS AFFILIATES, AND THEIR RESPECTIVE EMPLOYEES, VOLUNTEERS, MODERATORS, AND AGENTS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, ABOUT THE BLOOM COMMUNITY. WE ALSO DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. THE LAWS OF CERTAIN JURISDICTIONS OR STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES. TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER THE LAWS OF YOUR JURISDICTION, WE LIMIT THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE FULL EXTENT PERMISSIBLE UNDER THOSE LAWS.
THIS WARRANTY DOES NOT AFFECT ANY CONSUMER RIGHTS YOU MIGHT HAVE UNDER APPLICABLE LAW, INCLUDING THE LEGAL GUARANTEE IN CERTAIN PLACES SUCH AS THE EUROPEAN UNION THAT PRODUCTS AND SERVICES MUST COMPLY WITH THIS AGREEMENT AND YOUR RIGHTS IN CASE OF NON-CONFORMITY OF A PRODUCT OR SERVICE.
9. Updates

We may decide to update these Terms of Use from time to time for legal or regulatory reasons, to prevent abuse on or of the Bloom Community or its members, or any other purpose as we determine. If these changes materially affect your use of the Bloom Community or your legal rights, we will give you reasonable advance notice (unless the updates are urgent). If you continue to use our services after the changes have taken effect, it means that you agree to the changes. If you do not agree with our updates, you must stop using the Bloom Community.
